I would like to take this opportunity to express disappointment with an article published in the October 31, 2017, edition of the Chronicle-Independent concerning a lawsuit filed against Kershaw County School District.

While the Chronicle-Independent’s inherent responsibility to cover topics of public interest including legal matters is understood and respected, I am extremely concerned that the District was not extended an opportunity to provide its perspective on the lawsuit and the other issues addressed in the article.

I do not think it is unreasonable to expect the Chronicle-Independent to require its reporters to abide by a basic journalism principle of including all viewpoints in this type of article. Although the District is unable to comment on the specific facts of the lawsuit in light of student privacy and confidentiality considerations and pending litigation, being extended the courtesy to address this matter would have been appreciated.

Had the District been afforded an opportunity to share its perspective on the issues giving rise to this article, it would have explained that the system has complied with both applicable Board of Trustees’ policies and state law. Additionally, the District would have noted, as reflected in its pending Motion to Dismiss, that this lawsuit should be dismissed as a matter of law and that the District intends to vigorously defend itself and its employees against these allegations.

The Chronicle-Independent and the District have enjoyed a positive, harmonious working relationship over the years. The staff and students of the school system appreciate such a professional association and trust the same will continue. My sole purpose in writing this letter is to ensure readers and subscribers have a balanced picture of the situation and understand that the claims made by the Plaintiff are simply that -- claims and not facts.
